Version 1.1
Partner Agreement.
One page, in plain language, before anyone onboards a pickup site, a farm, or a storefront. Read the summary in a minute. The full terms sit right below it.
The short version
If you only read one thing, read this.
- A Fresher Place takes no cut of the food dollar.
- AFP never holds your funds and is never the merchant of record for food.
- Family information is used to run the pickup and nothing else. It is never sold.
- There is no cost to host a basic pickup.
- Either side can exit with 30 days notice.
- Your community can veto how it is represented.
1. Parties and purpose
This agreement is between A Fresher Place ("AFP") and the organization, farm, or site operator accepting it (the "Partner").
The purpose is simple. AFP builds the software, listings, and coordination that help a community find fresh food. The Partner runs the food. This document sets out how the two fit together so nobody has to guess.
2. The money firewall
The Partner is the merchant of record for all food sales. The Partner keeps 100 percent of the food dollar.
A Fresher Place charges no commission and takes no cut of the food dollar. Standard payment-processing fees set by the processor, for example Stripe or Square, still apply.
AFP takes 0 percent of food sales, never touches the food dollar, and never receives, holds, routes, or reconciles SNAP funds. Where a Partner connects their own payment processor, funds settle directly into the Partner account. AFP is not a payment facilitator, not a marketplace of record for food, and holds no Partner balance at any time.
3. Benefits are handled by the Partner
SNAP, EBT, WIC, Senior FMNP, and local bonus programs are accepted and processed on the Partner own FNS-authorized terminal, under the Partner own FNS authorization.
AFP does not hold an FNS number on the Partner behalf, does not process benefit transactions, and does not act as an agent for benefit redemption. AFP may display which benefits a site accepts so families know before they travel.
4. Family data, and what we do with it
Families give their name, email, phone, pickup choice, and share selection to A Fresher Place directly, on A Fresher Place pages. A Fresher Place holds that information in its own systems, and named A Fresher Place staff can see it.
The Partner receives what it needs to fulfil the order. A Host receives only the pickup roster: who is coming and what they are collecting.
A Fresher Place never sees or stores card numbers or benefit card numbers. Those stay with the payment processor and with the Partner own accounts and terminals.
A Fresher Place uses this information to operate the pickup, and for nothing else. It is never sold, never licensed, never shared with advertisers, and never used to train third-party models.
Only aggregate, de-identified figures ever reach a funder, an institution, or any other third party. No individual-level record leaves A Fresher Place, the Partner, and the Host without that family explicit consent.
A Partner or any family may request a copy of their records, or ask for them to be deleted, by writing to hello@afresherplace.com. A Fresher Place will action the request within 30 days.
5. Security
A Fresher Place is responsible for the security of the platform: the site, the database, the payment integration, and access control. A named individual at A Fresher Place holds that responsibility.
The Partner is responsible for its own payment account and its own benefit terminal, including who holds the credentials. A Host is responsible for the physical security of the site and of any printed roster.
If A Fresher Place learns of unauthorised access to family data, it will notify the Partner and the Host within 72 hours of becoming aware, say what was affected, and notify affected families as the governing law under section 12 requires.
Nothing in this section moves the platform security obligation onto the Partner or the Host.
6. No cost to host a basic pickup
Listing a pickup site, a farm, or a basic storefront costs the Partner nothing. There is no listing fee, no per-order fee, and no revenue share on food.
Optional paid services, such as institutional reporting, compliance templates, or licensed library content, are separate and always opt-in with their own written terms. Declining them never affects a Partner listing.
7. The food-as-medicine rule
Neither party will claim that a food cures, treats, or prevents a disease. AFP publishes cultural and nutritional context, not medical claims.
The Partner will not add disease-cure language to listings, signage, or messaging distributed through AFP. Where a nutritional claim is made, it is presented with its evidence register and never as medical advice.
8. Cultural respect and the community veto
Crops, recipes, and food knowledge belong to the communities that carried them. AFP will name origins with care and will not flatten a food into a trend.
A community that a listing or story represents may object to how it is represented. That objection is a veto, not a suggestion. AFP will change or remove the content, and the Partner may do the same for content about its own community.
9. Roles and responsibilities
The Partner is responsible for: food safety and handling, its own licenses and insurance, honest listings and pricing, holding pickup windows it publishes, its own payment and benefit terminals, and telling AFP when details change.
AFP is responsible for: keeping the listing accurate once informed, keeping the platform available on reasonable effort, protecting family and Partner data as set out in sections 4 and 5, keeping the money firewall intact, honoring the community veto, and providing the Partner a copy of its records on request.
10. Term and exit
This agreement starts when the Partner accepts it and continues until either side ends it.
Either side may exit with 30 days written notice, for any reason or no reason. On exit, AFP removes the Partner listings. The Partner may request a copy of its records, or ask for them to be deleted, by writing to hello@afresherplace.com, and A Fresher Place will action the request within 30 days, except where records must be retained by law. Money already settled to the Partner stays with the Partner. There is no exit fee.
11. Liability and no warranty
The platform is provided as is, without warranty of any kind. AFP does not warrant uninterrupted service, and does not assume liability for food quality, food safety, licensing, or the Partner payment and benefit processing.
Neither party is liable to the other for indirect, incidental, or consequential damages. Each side stays responsible for its own acts, omissions, and compliance obligations.
12. Governing law
This agreement is governed by the law of the state where the Host pickup site is located, without regard to conflict-of-law principles. That state is the one recorded in the site own details.
Venue for any dispute is the state and federal courts serving that location.
13. Not legal advice
This document is written in plain language so a partner can read it without a lawyer. It is not legal advice, and it is not a substitute for the Partner own counsel.
Attorney review of this agreement is pending. Version 1.1 reflects how AFP operates today. If a reviewed version changes anything material, partners will be notified before it takes effect and may exit under section 10.
