Terms of Service
Effective date: October 19, 2026
1. Who these terms are with
A Fresher Place is operated by FINxTIN TECH LLC ("A Fresher Place", "we", "us"). A Fresher Place is a doing-business-as name of FINxTIN TECH LLC. By using the platform, creating an account, or applying as a partner, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the platform. Contact: hello@afresherplace.com.
2. What A Fresher Place is, and is not
A Fresher Place is a software platform that connects families with local farms and partners through neighborhood pickups, a produce and food-as-medicine library, community content, and partner tools. We are the technology and coordination layer. We are not a grocer, a farm, a medical provider, or a payment processor for family food purchases. Farms and other partners are independent and are responsible for their own products, services, prices, food safety, and legal compliance.
Families never pay A Fresher Place for food, and we never touch the food dollar or your SNAP or EBT benefits. Where produce is sold, the farm receives payment directly through its own payment processor, and the farm keeps its full price.
3. Who may use the platform
You must be able to form a binding agreement to use partner accounts, and you must provide accurate information. The platform is not directed to children under 13. You are responsible for keeping your account secure and for activity under it.
4. Accounts and partner roles
When you apply as a partner (farm, host, community organization, chef, or steward), you agree to give accurate information and to keep it current. Some roles require you to accept a separate partner agreement, and some require our review and approval before your profile or listing becomes public. Approval is at our discretion, and we may decline, pause, or remove a partner to protect the community.
5. The vetted-location and safety rules
Pickups, classes, and events happen only at locations we have vetted. Partners may select only vetted locations. Vetting is a good-faith review, not a guarantee: partners and hosts remain responsible for the safety, legality, permits, and food-safety compliance of their own activities and sites. Chefs who handle or serve food are responsible for holding the required food handler credentials and for following local food-safety law, and for relying on the host location’s food permit where applicable. A Fresher Place does not assume responsibility for a partner’s food handling.
6. Acceptable use
You agree not to misuse the platform. That includes not posting false, harmful, infringing, or unlawful content, not impersonating others, not attempting to gain unauthorized access, not scraping or overloading the service, and not using the platform to harass anyone or to collect personal information without permission. We may remove content or suspend accounts that break these rules.
7. Your content and community stories
You keep ownership of the content you submit, including profiles, recipes, stories, and photos. By submitting content and granting the related consent, you give A Fresher Place permission to display, feature, lightly edit, and share that content on and about the platform, with attribution and under the consent you gave, so we can run the community feed, produce profiles, and community content. You confirm you have the right to share what you submit, and that everyone recognizable in a photo agreed to appear. You can ask us to remove your content, and we will honor that for content we control. We never publish a minor’s name or face in a community story without a parent or guardian’s consent.
Household-level survey answers are community-owned and are governed by our Privacy Policy and the consents you give, not by a general content license. We do not sell them.
8. Communications and consent
We contact you only through the channels you opt into, plus necessary service messages about your account. Marketing opt-ins are always optional and never a condition of applying or partnering. You can unsubscribe from email at any time. If and when we offer text messages, text consent will be a separate opt-in and you can reply STOP to cancel.
9. Partner payments and independence
Where the platform supports commerce, farms and vendors are paid directly through their own payment processors and set their own prices. A Fresher Place’s revenue is its technology, reporting, and platform fees, not a share of the food dollar or of any grant or benefit funds. Farms and vendors are paid through their own third-party payment processors, such as Stripe or Square, and those processors charge their own standard processing fees, which A Fresher Place does not set and does not receive. Partners are independent contractors and businesses, not employees or agents of A Fresher Place, and nothing here creates a partnership, joint venture, or employment relationship.
10. Intellectual property
The platform, including its software, design, and the libraries and content A Fresher Place creates, belongs to FINxTIN TECH LLC and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the platform for its intended purpose. You may not copy, resell, or create derivative works from the platform except as allowed by law or with our permission.
11. Third-party services
The platform relies on third-party providers (for hosting, surveys, email, payments, and, in the future, texting) and may link to third-party sites. We are not responsible for third-party services or content, and your use of them is subject to their own terms.
12. Disclaimers
The platform is provided "as is" and "as available." To the fullest extent the law allows, we disclaim warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement. Food-as-medicine and produce information on the platform is educational and is not medical advice; consult a qualified professional for medical decisions. We do not warrant that the platform will be uninterrupted, error-free, or that any partner, product, or location will meet your expectations.
13. Limitation of liability
To the fullest extent the law allows, A Fresher Place and FINxTIN TECH LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the platform. Our total liability for any claim relating to the platform will not exceed one hundred dollars or the amount you paid us in the twelve months before the claim, whichever is greater. Some places do not allow these limits, so they may not fully apply to you.
14. Indemnification
You agree to defend and hold harmless A Fresher Place and FINxTIN TECH LLC from claims arising out of your content, your use of the platform, your activities as a partner, or your violation of these Terms or of law, to the extent the law allows.
15. Termination
You may stop using the platform at any time. We may suspend or end your access if you break these Terms or to protect the community. Sections that by their nature should survive termination, including content licenses you granted, disclaimers, and limitations of liability, survive.
16. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules, and disputes will be handled in the state or federal courts located in New Mexico, unless the law where you live requires otherwise.
17. Changes to these terms
We may update these Terms as the platform grows. We will post the new version with a new effective date, and for material changes we will make a reasonable effort to tell you. Continuing to use the platform after a change means you accept the updated Terms.
18. Contact
Questions about these Terms: hello@afresherplace.com, or 4300 Ridgecrest Dr SE, Suite L 1255, Rio Rancho, NM 87124.
19. My AFP accounts
My AFP terms version: myafp-terms-1
My AFP is an optional, free account for adults 18 or older. It lets you save foods and verified places and keep an optional search ZIP. When you answer that you are 18 or older, that is your own statement; we do not verify age.
Saving a food or place does not request food, reserve a pickup, sign you up for messages or count as a survey answer. Your saved items and search ZIP are private to your account. Partners, hosts and organizations do not see them. Your search ZIP is a search preference, not your home address.
You can remove saved items and clear your search ZIP in My choices, including when you have not accepted updated My AFP terms. To close your My AFP workspace, contact us. We will confirm control of the account before removing its saved items and search ZIP. Deleting your sign-in account is a separate step because it may also provide access to other AFP services. We will explain any remaining records and access before taking that step.
Email choices are managed through the unsubscribe link in each email. Closing your account does not by itself unsubscribe you, and unsubscribing does not close your account. Signing in does not change your survey permissions, and closing your account does not withdraw survey answers; you can ask us about that separately.
If we change this section, My AFP will ask you to review and accept the new version before you can save again.
20. Publishing on A Fresher Place
Creator terms version: creator-terms-1
Approved contributors can publish their own work on A Fresher Place: articles, field notes and links to work published elsewhere. Your work appears on its own page and on your public profile. Distribution in the Community Feed becomes available when that feature launches.
You may publish only work that is yours or that you have permission to publish. Before you publish, you confirm that you have the necessary permissions for any people, interviews, images or media your work includes, and that it makes no health or medical claims. Material you cannot confirm stays private.
You retain your ownership rights. Third-party material remains subject to its owners' rights and the permissions you obtained. By publishing, you allow A Fresher Place to display your work, and short excerpts and links to it, on the website for as long as it stays published. You can edit or unpublish your work at any time, including if you are no longer eligible to publish. Unpublishing removes it from public pages.
Publishing does not mean A Fresher Place has verified your work. A Fresher Place may place a hold on a published work while it is reviewed, with a reason. While a hold is in place the work is not public, and you can revise it and request its release.
If you are an authorized owner or catalog manager of a farm on A Fresher Place, you can publish as that farm. Publishing as an organization is not yet available.
Publishing is unpaid unless a separate written agreement says otherwise. Publishing alone does not appoint you to an AFP role or create a paid assignment, commission or employment relationship.
If we change this section, we will ask you to review and accept the new version before you publish again.
